These policies govern the use of the GCLOUT participatory governance platform (“Platform”), operated by GCLOUT Limited (“GCLOUT,” “we,” “us,” or “our”). GCLOUT is a participatory governance technology platform designed to facilitate transparent, accountable, and structured civic engagement between citizens and governance representatives.

By using the GCLOUT, you acknowledge that you have read and understood this Privacy Policy and you agree to the collection and use of information in accordance with this policy.

The Policy applies to all users globally and is designed to comply with: Nigeria Data Protection Act (NDPA), UK GDPR & Data Protection Act 2018 and EU General Data Protection Regulation (GDPR). Where local laws impose additional obligations, those laws shall prevail.

  • Account Registration Data: Your full name, email address, phone number, password, preferred username, residential address and date of birth.

  • Governance and Civic Opinion Disclosure: By posting on this Platform, you acknowledge that you are voluntarily disclosing data concerning your governance opinions, civic interests, and community issues, which is deemed sensitive. You understand that your use of the Platform is conditional on the deliberate submission of this sensitive data in furtherance of the Platform's civic mission.

  • Communications: Records of correspondence when you contact us for support or inquiries.

1.2 Information Collected Automatically
  • Usage Data: Information about how you access and use the Platform, such as your IP address, browser type, operating system, pages viewed, time spent on pages, and referring website addresses.

  • Device Information: Details about the device you use, including the device type, unique device identifiers, and mobile network information.

  • Geolocation Data: If you enable location services, we may collect precise or approximate location data to filter local issues and content relevance.

1.3 Data Sourced from Public Records
  • Representative Activity Data: We collect and process public information pertaining to elected officials, including their proposals, voting records, policies, project updates, and public engagement schedules. This data is collected from publicly accessible sources and is processed to provide transparency features on the Platform.

  2. To Fulfill Our Mission: To enable transparency and accountability by displaying public data and facilitating structured civic engagement.

  3. To Localize Content: Using location data to connect you with your specific electoral districts, local issues, and relevant representatives.

  4. To Moderate and Improve UGC: Reviewing user reports and discussion content to ensure compliance with our Terms and Conditions and to enhance the quality of civic discourse.

  5. To Communicate with You: Sending service announcements, technical notices, security alerts, and administrative messages.

  6. For Security and Compliance: Detecting, preventing, and addressing fraud, security threats, or illegal activities, and complying with legal obligations.

  7. For Analytics: Analyzing usage and trends to improve the Platform’s features, performance, and user experience.

4. How we share and disclose your data

We may share your information in the following ways:
  • Publicly on the Platform: Your User-Generated Content (posts, comments, reports) is public and viewable by other users, including elected officials/supported party. Your username will be associated with this content.

  • With Representatives and Government Bodies: We may share issue reports and aggregated feedback data with the relevant elected officials or public service departments to fulfill the platform's mission of connecting citizens and government.

  • Service Providers: We engage third-party companies and individuals to perform services on our behalf (e.g., hosting, data analysis, security). They have access to your data only as necessary to perform their functions and are obligated not to disclose or use it for any other purpose.

  • Business Transfers: In connection with a merger, acquisition, or asset sale, your Personal Data may be transferred.

  • Legal Compliance: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to

    1. comply with a legal obligation,

    2. protect and defend the rights or property of GCLOUT,

We will respond to valid legal process from government and law enforcement entities (e.g., court orders, subpoenas, or warrants) as required by the law of the Jurisdiction of GCLOUT. Due to the governance nature of the Platform, we maintain a policy to challenge requests for user data that we believe are overly broad, vague, or legally flawed, whenever legally permissible. However, we may be legally compelled to disclose data, including sensitive governance and location data, to government or law enforcement entities. We will attempt to notify affected users prior to disclosure, unless legally prohibited from doing so.
