GClout’s Privacy Policy

These Terms and Conditions (“Terms”) govern your use of the participatory governance platform (“Platform”) provided by GCLOUT (“the Platform”, “we”, “us”, or “our”). The Platform is designed to connect citizens and governance representatives to improve transparency, accountability, and civic engagement.

By accessing or using the Platform, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Platform.

1. Account Registration and Eligibility

1.1 Eligibility

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.

1.2 Account Responsibility

You are responsible for safeguarding the password and other credentials used to access the Platform. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

1.3 Accuracy of Information

You agree to provide current, complete, and accurate registration information and to update such information as necessary. Impersonation of any person or entity, including elected officials or government personnel, is strictly prohibited.

2. User Conduct and Prohibited Uses

The Platform is intended for respectful civic dialogue and constructive engagement. You agree not to use the Platform:
2.1 Illegally or fraudulently:

In any way that violates any applicable national, federal, state, local, or international law or regulation.

2.2 Harmful Content:

To transmit, upload, or post material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

2.3 Hate speech and discrimination:

To promote or engage in discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

2.4 Impersonation and Misrepresentation:

To impersonate GCLOUT, a GCLOUT employee, another user, or any elected official or government entity. This includes posting information that is false, inaccurate, or misleading about a representative’s activities or a public service issue.

2.5 Unauthorized Governance Activity:

To post content or links that constitute organized governance campaigning, paid lobbying, or direct solicitation of governance donations for any candidate, governance party, or governance action committee without express written authorization from GCLOUT.

2.6 Disruption:

To interfere with or disrupt the operation of the Platform or the servers or networks used to make the Platform available.

2.7 Commercial Use:

For any non-civic, unauthorized commercial or spamming purposes, including advertising, soliciting, or selling services without our express written consent.

3. Intellectual Property Rights

3.1 GCLOUT Content:

All content, features, and functionality on the Platform, including text, graphics, logos, and software, are the exclusive property of GCLOUT or its licensors and are protected by copyright, trademark, and other intellectual property laws.

3.2 User-Generated Content (UGC):

You retain ownership of all intellectual property rights in the content you create and post on the Platform. By submitting UGC, you grant GCLOUT a perpetual, irrevocable, worldwide, royalty-free, and non- exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, solely for the purpose of operating, improving, and promoting the Platform and its mission of civic engagement.

3.3 Public Data/Representative Activity:

Data collected regarding the activities of governance representatives (voting records, proposals, etc.) is sourced from public records. GCLOUT claims no proprietary rights over the underlying public data but owns the compilation, display, and organization of that data on the Platform.

4. Disclaimers and Limitation of Liability

4.1 Petitions, Polls and Governance Activity:

GCLOUT allows the creation of governance and non-governance polls and petitions. Users are solely responsible for the accuracy, legality and authenticity of such content. We do not endorse any petition, campaign or governance party featured on the Platform.

4.2 Disclaimer of Government Status:

GCLOUT IS AN INDEPENDENT TECHNOLOGY PLATFORM AND IS NOT A GOVERNMENT AGENCY, BRANCH, OR AFFILIATE. We do not represent any government body or official. All information from representatives is provided by them or sourced from public records and is presented for informational purposes only.

4.3 No Responsibility for Actions of Officials:

GCLOUT facilitates communication and transparency but has no control over, and assumes no responsibility for, the actions, inactions, proposals, or voting records of any elected official or government entity featured on the Platform.

4.4 No Guarantee of Outcome:

GCLOUT does not guarantee that posting an issue report, participating in a consultation, or submitting feedback via the Platform will result in a change in policy, resolution of an issue, or any official response from a governance representative. The Platform provides tools for engagement but makes no warranties regarding the efficacy or outcome of that engagement.

4.5 Accuracy of UGC:

We do not verify the accuracy of user reports or feedback regarding local issues. While we reserve the right to moderate, you acknowledge that you rely on User-Generated Content at your own risk.

4.6 Disclaimer of Warranties:

You assume full responsibility for your use of the Platform. The Platform is provided exactly as it exists at the time of use, without assurances regarding its performance or quality. We disclaim all representations and guarantees, whether express or implied.

4.7 Limitation of Liability:

GCLOUT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from

  1. your use or inability to use the Platform;

  2. any unauthorized access to or use of our servers and/or any personal information stored therein;

  3. any conduct or content of any third party on the Platform.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without prejudice to mandatory consumer protections in other jurisdictions.

6. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable advance notice of any material changes. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.
